Instructions TO APPELLANT FOR Filing APPEALS

 

1) File an application with the enforcing officer of the Zoning Resolution (Crosby Township Zoning Inspector) for a Zoning Certificate (in triplicate). If the enforcing officer refuses to issue the Zoning Certificate, you will receive a letter showing the reason for his refusal and the Section numbers under which you may appeal to the Crosby Township Board of Zoning Appeal

 

2) Prepare an explicit statement (typewritten preferred), addressed to the Board of Zoning Appeals, setting forth the following:

 

Specific references to the Section of the Zoning Resolution which, it is claimed, authorizes the determination sought (These can be found in the refusal issued by the enforcing officer and in the text of the Zoning Resolution of Crosby Township. Ohio).

 

A clear and accurate description of the construction or use.

 

All facts and reasons why the determination sought should be granted.

 

A typewritten list of names and complete addresses of the property owners of all abutting lots and lands including those across the street opposite the property involved in this appeals. (Said list must be prepared from the County Auditor's tax list.)

 

3) Present personally (do not mail) the aforesaid typewritten statement, along with a list of property owners, at the office of the Board of Zoning Appeals.

 

4) An appeal fee is required in the form of a $300.00 deposit. (All checks must be made payable to the Crosby Township Trustees.

 

5) All forms, including notices, necessary for filling of an appeal, will be executed by this office.

 

6) A legal notice will be prepared by this office and placed in a newspaper of general circulation in the county two weeks before the public hearing.

 

ADDENDA: The plats and plans previously filed for a Zoning Certificate may be used when filing the appeal, provided said plats and plans are drawn to a scale and show the actual shape and dimensions of the lot to be built upon: the exact size and location on the lot of the buildings and accessory buildings existing, and the lines within which the proposed building shall be erected or altered: the existing and intended use of each building or part of a building: the number of families or housekeeping units the building is intended to accommodate, and such other information with regard to the lot and neighboring lots as may be necessary to provide for a proper hearing and determination of the appeal.  Where a new building is being constructed, all dimensions shown on the plans relating to the location of the building and size of the lot to be built upon, shall be an actual survey.  Where addition, alteration or the use of existing building or premises is involved, the plot plans filed must be based upon an actual survey. Four sets of plans are necessary before an appeal is filed.
